These General Conditions shall apply to the relationship between consumers and users (hereinafter the “Customer”) and MONTERO CABANA KIDS, SL (hereinafter “Montero Cabana Kids” or “Company”) with CIF B-21689724, registered office at C / Cerrajería 19, 41004 (Seville) and registered in the Commercial Register of Seville, entry 4093, Page SE-148449, 1st Registration. Hereinafter, the Client and Montero Cabana Kids may be jointly referred to as the “Parties”. Together with the particular conditions that may be established in relation to each specific contractual relationship, the General Conditions expressly regulate the access, use and commercial relations between the Customer and Montero Cabana Kids through the marketing platform accessible on the website https://www.beatrizmontero.es/es/ property of Montero Cabana Kids.
The user will be subject to the conditions in force at the time of placing the order, which will remain in force and will be valid, not only during the time they are accessible through https://www.beatrizmontero.es/es/ (hereinafter, the “Web”), but until the complete completion of the contract initiated when they were still accessible on the Web.
However, Montero Cabana Kids reserves the right to replace them at any time, as well as all those legal notices, privacy policy, guidelines and / or regulations for use contained in the Web, and that, as appropriate, replace, supplement and / or modify the general conditions contained herein. For the validity of the contracting made through the Web, it is a necessary and indispensable requirement that the Client, when initiating the same, has the capacity to contract according to the Spanish Law.
The contract entered into between Montero Cabana Kids and the Client through the Web (hereinafter, the “Contract”) is for the distribution of children’s clothing products and accessories (hereinafter, the “Products”). In the relevant sections of the Web are reflected the characteristics of the Products, as well as the particularities of each purchase transaction that the Customer can perform in this environment.
All prices of the products offered on the Web are shown in euros and VAT included. The price of the products, unless expressly stated, does not include shipping costs thereof, which shall be borne by the Customer. In this sense, Montero Cabana Kids will inform the Customer during the purchase process what are the shipping costs of the order before finalizing the process.
If by an accidental malfunction of the operation of the Web there was a manifest error in the price of the product, Montero Cabana Kids will contact the Customer as soon as it becomes aware of the same to duly inform you of this fact, offering in these cases the option to reconfirm the order with the correct price or cancel it without incurring an additional cost to the Customer.
The prices of the products shown on the Web are exclusive to the online channel and may not correspond to the prices that may be offered in the physical store/s of Montero Cabana Kids. For large orders, the customer can request a custom quote and access to special prices. The Company will try to adapt it to the specific situation of each customer.
The Company reserves the right to change prices at any time, reflecting as soon as possible the new price on the website and the corresponding advertising media. In any case, the user will always be governed by the conditions and prices that are determined at the time of purchase. The prices and promotions that are indicated in this portal are valid only for orders placed through it, and may sometimes differ from the prices and promotions applicable in other establishments of the Company.
Each shipment will have a different cost depending on the quantity of products, weight, dimensions and destination of the total package. Our Commercial Agent will inform you in advance of the cost of transport to your destination. The Company works with the main transport operators in order to guarantee the best prices, deadlines and services in the market.
The descriptions of the products displayed on the Website are prepared based on information provided by suppliers of Montero Cabana Kids. The photographs, videos, trade names, trademarks or distinctive signs that appear on the website correspond to the actual products offered for sale, with the aim of providing the most truthful and accurate information possible about their characteristics. However, it is noted that such information is not exhaustive, so the Customer must take into account possible variations.
All the products marketed have been manufactured under strict quality controls by their respective manufacturers and comply with the current European Union regulations applicable to their sector.
The Contract between the Customer and Montero Cabana Kids will be perfected at the time the Customer confirms the order of the product, following the procedure detailed below:
a) The Customer will place the order for the product through the website, completing the various stages that the website will indicate (see section “6. PURCHASE PROCESS”), including the express acceptance of having read, understood and accepted both the conditions of use and these General Conditions of Contract.
b) Once the contracting conditions are accepted, Montero Cabana Kids will proceed to the electronic storage of the order.
c) Montero Cabana Kids will contact the Customer through the email address provided during the purchase process, in order to notify the receipt of the order. This communication will be purely informative and does not yet imply the formalization of the purchase contract.
d) The contract will be considered completed only at the time that Montero Cabana Kids confirms the product order by sending the Customer an email “Order Confirmation”, which will be sent after verifying the payment of the corresponding amount in accordance with the provisions of these General Conditions. There will be no contract with respect to those products not expressly included in such Order Confirmation.
Notwithstanding the foregoing, in those exceptional cases in which circumstances such as abusive orders, multiple requests simultaneously or any other cause that causes the unavailability of the product during the order registration process, Montero Cabana Kids may terminate the contract and proceed to the cancellation of the order, refunding the Customer, if any, the full amount paid.
1.- Registration: It is an essential requirement for the Customer to register as a user of the website in order to be able to buy online. To do this, you can access the “User Registration” section. When registering, the Client will have the possibility to create and modify his profile, consult his order history, modify his password and update other personal data.
In accordance with the provisions of the Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, Montero Cabana Kids informs the Customer that the personal data collected during the registration process and subsequent purchase will be incorporated into a file under its responsibility, in order to process the actions taken by the user and manage any derived action.
Likewise, Montero Cabana Kids informs about the possibility of exercising the rights of access, cancellation, rectification and opposition by writing to the following address: C/ Cerrajería 19, 41004 (Sevilla).
Until otherwise communicated, it is understood that the data provided have not been modified, that the Client agrees to notify any change and that Montero Cabana Kids has the consent to use such data in order to maintain the relationship between the parties.
During the purchase process, the Customer must identify himself/herself with the user name and password provided at registration. These data will not be public and the Customer is responsible for treating them with confidentiality and not to transfer them to third parties.
2.- Order processing: The Customer may access his/her account or, if not registered, browse directly through the catalog to select the desired products, which will be added to the cart by clicking on the “ORDER” button. Once all the products have been selected, the Customer must click on the “PROCESS ORDER” option.
Next, a screen will be displayed to enter personal and shipping data. In the case of registered customers, these data will be filled in by default, and can be modified by the customer if desired.
If the Customer wishes to receive the order at an address other than the billing address, the Customer must expressly mark this option.
3.- Selection of the payment method: The Customer must select the payment method with which he/she wishes to make the payment of the order.
When paying by credit card or PayPal, the Customer may use the corresponding payment gateway or pay directly by credit card. The card issuers will check the payment, and if they do not authorize it, the purchase process cannot be completed and the order will be cancelled.
The applicable shipping costs will be added to the price published on the website for each product, which will be previously communicated to the Customer before formalizing the purchase.
Finalization of the order: Finally, after reviewing and correcting any errors detected in the form, the Customer must click on the option “FINISH ORDER”. Once confirmed, Montero Cabana Kids will proceed to manage and prepare the order.
At that time, the Customer will receive an order confirmation email.
The Customer will receive his order at the indicated address within the stipulated period, accompanied by the corresponding delivery note or invoice.
Montero Cabana Kids is committed to deliver the products in perfect condition at the address provided by the Customer in the order form. In order to optimize the delivery process, it is recommended that the Customer provide an address where the order can be delivered within normal business hours.
Montero Cabana Kids will not be liable for any errors or damages resulting from a failed delivery when the address provided by the Customer does not conform to reality, is incomplete or has been omitted in whole or in part.
The products purchased will be delivered to the person or entity and at the address specified by the Customer, within the period indicated at the time of purchase and according to the shipping method selected. Acceptance and payment of the order implies the express agreement of the Customer with the chosen shipping method, as well as with the costs derived from it.
No deliveries will be made to post office boxes.
In the event that the Customer wishes to purchase products from a country other than those available in the purchase process, you can contact Montero Cabana Kids via email pedidos@beatrizmontero.es. The team will contact to report on the feasibility of the shipment and the necessary procedures.
For any incident or doubt related to the delivery, Montero Cabana Kids will contact the Customer using the data provided in the order form.
Unless there are exceptional circumstances, such as specific customizations of the products, logistical contingencies or force majeure, Montero Cabana Kids will send the products covered by each Shipping Confirmation within the period established during the purchase process, and in any case, within a maximum period of 30 working days for domestic shipments, counted from the date of departure of the order from the company’s facilities.
In the event that the maximum delivery date cannot be met, and provided that there is no justified cause, the amount paid by the Customer will be refunded in full.
Orders placed will be processed from the next business day after receipt.
The Customer is informed that the delivery times indicated are estimates, so they could be modified for logistical reasons or other circumstances beyond the control of Montero Cabana Kids. In case of delay in delivery, it will be communicated to the Customer as soon as it becomes known.
Each delivery will be considered completed from the moment the transport company makes the order available to the Customer, a circumstance that will be recorded by the tracking system used by the transport company.
Montero Cabana Kids offers various payment methods to suit the needs of its customers, which will be available and updated during the purchase process. Options include payment by credit or debit card (Visa, Mastercard, American Express, Visa Electron and other similar cards), PayPal (with a 3.5% surcharge) and bank transfer.
When paying by credit card or PayPal, the Customer may use the corresponding payment gateway or pay directly by credit card. The card issuers will check the payment, and if they do not authorize it, the purchase process cannot be completed and the order will be cancelled.
The applicable shipping costs will be added to the price published on the website for each product, which will be previously communicated to the Customer before formalizing the purchase.
The Customer undertakes to notify any undue or fraudulent charge on the card used for purchases by e-mail to pedidos@beatrizmontero.es as soon as possible, so that appropriate action can be taken.
1.- Returns: The Customer will have a period of 10 calendar days from receipt of the order to request the return of products purchased through the website www.beatrizmontero.es. Returns will be handled free of charge to the Customer.
To initiate the return process, the Customer must send an email to the address pedidos@beatrizmontero.es, indicating the order reference and the products you wish to return. Upon receipt of the request, Montero Cabana Kids will coordinate the collection of the item at the customer’s home through a transport company.
Once the product has been received at the facilities of Montero Cabana Kids and verified that it is in perfect condition and in its original packaging, we will proceed to refund the corresponding amount, which will be made by the same method of payment used in the purchase.
2.- Size change: In the event that the Customer wishes to make a size change, he/she must place a new order on the website. Before finalizing the purchase, he/she must indicate in the observations field the mention “Return shipment for size change“.
The carrier will deliver the new order and simultaneously collect the garments that the Customer wishes to return. Once the garments are received at the facilities of Montero Cabana Kids and checked their condition, the amount of the returned garments will be paid, using the same means of payment used initially.
3.- Right of withdrawal: The Customer shall have the right to withdraw from the contract without justification and without penalty, within 7 calendar days from receipt of the product.
To exercise this right, the Customer must communicate in writing by e-mail to pedidos@beatrizmontero.es, clearly indicating his intention to withdraw from the contract.
The Customer must return all the products corresponding to his purchase in perfect condition, without having been used, and in their original packaging, including the cellophane or seals if any, sending them to the sender’s address.
The shipping costs associated with the return in exercise of the right of withdrawal shall be borne by the Customer, and Montero Cabana Kids will reimburse only the amount of the returned products.
Alternatively, the model withdrawal form included in these Conditions as Annex I may be used.
Claims for damage in transit: It is the responsibility of the Customer to verify the condition of the order at the time of delivery. In the event that obvious damage to the packaging is detected, it must be noted in writing on the delivery note of the carrier at the time of delivery and communicated to Montero Cabana Kids as soon as possible.
If the damage was not visible at the time of delivery, but is detected later, the Customer must notify by email to pedidos@beatrizmontero.es within a maximum of 7 calendar days from receipt of the order.
Montero Cabana Kids will not assume any responsibility for damages resulting from transport if they have not been communicated within the established deadlines.
Montero Cabana Kids implements the maximum security measures commercially available in the industry to protect the information and personal data of its customers.
The payment process is done through a secure server using SSL (Secure Socket Layer). This secure server establishes an encrypted connection using 128-bit algorithms, ensuring that the information transmitted can only be decrypted and interpreted by the customer’s computer and the server Montero Cabana Kids.
Once the Customer enters his payment details, the corresponding bank will validate the credit card. Only after this validation will the corresponding amount be charged, at which time the order will be considered effective and its processing and shipment will begin.
Montero Cabana Kids does not store the customer’s bank details, thus ensuring confidentiality and security in transactions made through the web.
Montero Cabana Kids reserves the right to modify the offers available on the website without prior notice.
2.- Orders may be rejected in case of lack of stock or non-payment by the Customer.
3.- It will keep the ownership of the products until the Customer has paid in full.
4.- It may make changes to the website without prior notice, as well as temporarily or permanently suspend the service.
Human or computer errors detected may be corrected at any time, either by Montero Cabana Kids or by third parties authorized for that purpose.
Montero Cabana Kids does not guarantee the technical continuity, the absence of failures or interruptions of service, or that the online sales platform is available or accessible at all times.
All the contents of the Society’s catalog and website https://www.beatrizmontero.es/es/ (products, texts, images, brands, videos, etc.) is the exclusive property of Montero Cabana Kids, S.L., its suppliers and/or collaborators. The partial or total reproduction of the content must be authorized in writing by Montero Cabana Kids, S.L.
In the event that any of the stipulations contained in these General Conditions, or in any other contract binding the parties, is declared null and void, ineffective or unenforceable, such circumstance shall not affect the validity or enforceability of the remaining clauses. The affected provision shall be replaced by another that reasonably reflects the original intention of the parties, to the extent that they were aware of the nullity or ineffectiveness of the first.
Montero Cabana Kids S.L. reserves the right to modify, update or adapt these General Conditions at any time, so it is recommended to consult them periodically.
